Why parking penalty sent to the owner of the vehicle? What to do if the owner/responsible user of the vehicle was not the driver of the vehicle?
Like on public unsupervised for-free parking areas there are the same rules in private outdoor parking lots where car driver is responsible.
By parking conditions of Ühisteenused AS, parking operators are expecting that the contracting is a car driver or responsible person. As it is not possible for the operator to identify who was driving the vehicle at the time the penalty was imposed and the relevant information is known only to the owner or responsible user of the vehicle, the burden of proof lies with the owner / responsible user of the vehicle.
If the registered owner or responsible user of the vehicle did not drive the vehicle at the time of the parking violation, he can be released from liability if he proves that the vehicle was used by someone else (for example by presenting a contract for the sale or lease of the vehicle, confirmation from the actual user, etc.).
